Ginseng poachers take to the woods as prices soar

MADISON, Wis. (AP) ? They slink through the woods in camouflage and face paint, armed with tire irons, screwdrivers and hoes, seeking a plant that looks like a cross between a Virginia creeper and poison ivy.

They're the new breed of ginseng diggers, a rough and tumble lot looking to parlay rising Asian demand for the increasingly rare plant's roots into a fast buck.

Amid a sluggish economy, police say, more diggers are pushing into the backcountry from the upper Mississippi River to the Smoky Mountains in search of wild ginseng, eschewing harvest permits, ripping up even the smallest plants and ignoring property lines.

Their slash-and-burn tactics have left property owners enraged and biologists worried about the slow-growing plant's long-term survival. In Ohio prosecutors charged one landowner with gunning down a man he believed was stealing ginseng.

"We're not finding big, healthy populations. It was there, and a lot of it has been taken," said Nora Murdock, an ecologist with the National Park Service who monitors plant populations in four parks across the southeastern U.S. "It's like taking bricks out of a building. You might not feel the first brick ... but sooner or later you're going to pull out too many."

Ginseng, a long-stemmed plant with five leaves and distinctive red berries, long has been coveted in many Asian cultures because the plant's gnarly, multipronged root is believed to have medicinal properties that help improve everything from memory to erectile dysfunction. And the wild roots are believed to be more potent than cultivated roots.

The plant takes years to mature, and it has been harvested to the edge of extinction in China. Ginseng buyers have turned to North America, where the plant can be found from northeastern Canada through the eastern U.S.

Conscious of the harvesting pressure, the Convention of International Trade of Endangered Species of Wild Fauna and Flora imposed restrictions on exports in 1975. Under those terms, states certify ginseng has been harvested legally and exporters must obtain a federal permit. Most states have restricted ginseng harvest to a few months in the fall and require diggers to obtain permits during that period. It's illegal to harvest ginseng from any national park and most national forests in the southeast.

The price of wild ginseng roots has climbed in the last decade. Now domestic buyers pay $500 to $600 per pound compared with about $50 per pound of cultivated roots. Law enforcement officials say the prices have pushed people looking for quick money into the woods.

"It's lucrative to spend a day in the woods and walk out with $500 of ginseng in a bag when you don't have a job," said Wisconsin conservation warden Ed McCann. "Every one of these plants is like looking at a $5 or $10 bill."

Clad at times in camouflage, face masks and face paint to blend in, poachers trod through the underbrush with makeshift tools such as tire irons and screwdrivers looking for ginseng, police said. They don't have any qualms about digging up immature roots; they want to get at the plants before other poachers or before the state's harvest season begins. But that ensures the plants won't reproduce and feeds a cycle of dwindling populations and rising prices.

And poachers know how to get around the conservation regulations. They'll dig ginseng out of season to get a jump on competitors and take it to dealers when the season opens or purchase permits after the fact. In other cases dealers just look the other way, said John Welke, a Wisconsin conservation warden.

It's difficult to get a clear picture of the extent of poaching in the U.S. ? violation statistics are spread across layers of state and federal jurisdictions, but law enforcement officials and biologists across the eastern half of the country told The Associated Press they believe it's on the rise.

In Wisconsin, the leading U.S. producer of commercially grown ginseng, wildlife officials say violations such as harvesting wild ginseng without a permit or harvesting out of season tripled from 12 in 2007 to 36 last year.

Ohio wildlife authorities have made 100 arrests between 2008 and last year for various ginseng violations ranging from digging without permission to digging or buying out of season.

A team of West Virginia University researchers counted 30 ginseng populations across New York, Pennsylvania, Maryland, Indiana, Kentucky, Virginia and West Virginia between 1998 and 2009. The team reported that of the 368 plants they discovered had been harvested, only five were taken legally.

"It's very difficult to catch a poacher," said U.S. Forest Service botanist Gary Kauffman. "You could put everything in a backpack and your hands are clean, nobody really knows what you're doing."

A grand jury in southeastern Ohio charged 78-year-old Joseph Kutter of New Paris with killing a man whom Kutter claimed had trespassed onto his property to poach ginseng. According to court documents, Kutter shot Bobby Jo Grubbs with an assault rifle in May and hid his body in a mulch pile. Kutter's attorneys didn't return messages seeking comment.

Sara Souther, a University of Wisconsin-Madison botanist who worked on the West Virginia University ginseng team, said multiple times she has encountered poachers trying to harvest the plant.

"These are intimidating people," Souther said. "You can tell these men are not hiking. If you're out there and witness an illegal act, you don't know what people will do."

Audi Crosslane: A Hybrid Mongrel That Leans Electric

PARIS ? ?Crossover? can mean just about anything in the automotive industry. But with the Crosslane Coupe Concept, introduced here on Thursday, Audi shoehorned a remarkable number of referents into what was already something of a catch-all notion.

The Crosslane is a coupe, a convertible, a high-riding compact S.U.V., and, for good measure, a dual-mode plug-in gasoline-electric hybrid. Throw in features like a movable trunk and removable rear seats, and you have the makings of a walk-on in the next ?Transformers? film.

Audi says the hybrid powertrain is capable of fuel economy in excess of 200 miles per gallon, partly because of a lightweight, carbon-fiber-infused chassis and body structure. Audi said total vehicle weight was kept to 3,064 pounds, rather svelte among crossovers, by using an exotic mix of aluminum, carbon-fiber-reinforced polymer and fiberglass-reinforced polymer to create the concept?s space frame.

Looking like a potential challenger to the Land Rover Evoque, the Crosslane is powered by an equally exotic m?lange of technologies. The hybrid system combines a 1.5-liter 3-cylinder gasoline engine, rated at 130 horsepower and 148 pound-feet of torque, with two electric motors. The larger of the electric units produces the equivalent of 116 horsepower and 184 pound-feet of torque, and provides the only source of motive power up to 34 miles per hour. The smaller adds 68 horsepower and 155 pound-feet of torque and brings in an assist from the 3-cylinder engine at speeds up to 81 m.p.h. Above that, to its top speed at 113 m.p.h., the engine completely takes over.

For all those numbers, total system power averages out to a relatively lackluster 177 horsepower, Audi asserts. Still, the company says its Crosslane will sprint from a stop to 62 m.p.h. in a respectable 8.6 seconds.

The electric motor package uses a 17.4-kilowatt-hour lithium-ion battery and has a range of around 53 miles in gas-free E.V. mode, Audi said.

Ergonomically, the Crosslane has a movable trunk space, which can be pushed forward to allow easy access from inside of the cabin, or it can be moved backward to open up space for two rear seats. The concept has a removable targalike top that, when stowed, serves as a cover for the cargo space.

Whether a vehicle like the Crosslane could find its way into the Audi lineup is debatable. But as automakers adjust to more stringent fuel-economy standards worldwide, the prospects of a hybrid system like this finding its way there are far stronger.

The?Curiosity rover's latest Mars photo?captured the planet's largest Martian moon, Phobos, during a Martian evening, revealing the satellite as a faint crescent moon.

"Moon Over Mars: I snapped a pic of one of Mars' moons, Phobos, in the twilight sky over Gale crater," NASA's Curiosity team announced on the mission's Twitter page @MarsCuriosity, writing as the rover itself, on Wednesday (Sept. 26) ? the same day Curiosity made its longest drive yet.

The photo shows Phobos as a faint white crescent that almost blends in with the Martian sky. A black blemish also appears in the image, but is merely the result of a bad pixel in the image data, rover officials said.

"When you send images from 179 million miles away, stuff happens," they added via Twitter.?

The new photo of Phobos is Curiosity's latest view of Martian moons from the surface of the Red Planet. Earlier this month, Curiosity snapped photos of Phobos as it crossed part of the sun, creating a partial?solar eclipse on Mars.

Mars has two moons, Phobos and Deimos, both of which are much smaller than Earth's moon. Phobos is about 14 miles wide (22 kilometers), making it the largest Martian satellite. Deimos is about 9.3 miles across (15 km) at its largest point and is farther from Mars than Phobos.?

The Curiosity rover's Phobos photos are just part of the science work the car-size robot has been performing on Mars. The rover landed inside the planet's vast Gale Crater on Aug. 5 and is currently driving toward its first science destination, a location called Glenelg.

On Wednesday, Curiosity drove 160 feet (48.9 meters) closer to Glenelg, marking its longest single drive of its mission so far. To date, the rover has covered about a quarter-mile (416 meters) on Mars.

NASA's?Mars rover Curiosity?is expected to spend at least two years exploring Gale Crater to determine if the region could have ever supported microbial life. Mission scientists plan to drive the rover up a 3-mile (5-km) mountain ? Mount Sharp ?that rises from the crater's center.

Gay marriage arguments set for NY appeals court

NEW YORK (AP) ? A U.S. appeals court in New York is set to take its turn Thursday at considering the constitutionality of the Defense of Marriage Act, a federal law restricting the recognition of same-sex unions that has already been struck down in several other places.

A three-judge panel of the 2nd U.S. Circuit Court of Appeals will hear lawyers argue whether the law should be abandoned or preserved; a ruling is not expected for months. Already, the law has been struck down by a federal appeals court in Boston and five trial-level judges, including U.S. District Judge Barbara Jones in Manhattan.

She ruled that the law intrudes upon the states' regulation of domestic relations. Her June decision came after Edith Windsor sued the government in November 2010 because she was told to pay $363,053 in federal estate tax after her partner of 44 years, Thea Spyer, died in 2009. They had married in Canada in 2007.

The Justice Department is siding with lawyers for Windsor after President Barack Obama and Attorney General Eric Holder in February 2011 told the Department of Justice to defend the law no longer.

Windsor's lawyers said in court papers that the law does not benefit anyone because it defines marriage "to exclude married same-sex couples from the rights, privileges and obligations the federal government affords to all other married couples."

The law, which denies federal recognition of same-sex marriages and affirms the right of states to refuse to recognize such marriages, was passed by Congress and signed by President Bill Clinton in 1996 after it appeared in 1993 that Hawaii might legalize it. Since then, many states have banned gay marriage but several have approved it, including Massachusetts and New York.

In written arguments, former attorneys general Edwin Meese III and John Ashcroft say it is unprecedented that the government would not defend a law that does not involve concerns over the separation of powers.

"Historically, the president's constitutional obligation to 'take care that the laws be faithfully executed' has been understood to include the vigorous defense of acts of Congress when they are challenged in court," they said.

"It is no small step for a federal court to conclude that a coordinate branch of the federal government has acted irrationally," warned the Bipartisan Legal Advisory Group of the House of Representatives, which is defending the law.

The Justice Department said the law was motivated largely by disapproval of gays and lesbians and there was no governmental interest to justify the law's "differential treatment of same-sex couples who are legally married under the laws of their states."

1. Turnover of principals at Wood, Lincoln, Encinal and other schools have been high, how important do you think stable leadership is for schools?

I believe effective leadership is very important at each school site, and stability is a crucial part of that. As a parent of students that have attended two listed sites and as a Board member, I realize the difficulty in finding leadership that fits each sites with all the expected skills. While turnover can be frustrating in the short term, I believe it is more important to find the best leaders, whom we can support and develop for long-term leadership.

2. Describe your understanding of how Measure A funds have been allocated and what steps will you take to restore confidence in the voters who are angry about the way the funds generated by Measure A have been used?

Measure A funds have been allocated, and spent, exactly the way the ballot measure was stated. (Maintaining Small Class Sizes for grades K-3; Maintaining High Quality Neighborhood Elementary Schools; Secondary School Choice Initiative and AP Courses; Programs to Close the Achievement Gap; High School Athletics Programs; Enrichment Programs; Attract and Retain Excellent Teachers; Counseling and Student Support Services; Alameda Charter Schools; Technology; Adult Education)

It is frustrating to see intentional miss-statements about our spending and we try to correct them as best we can. By issuing regular reports, advising the stakeholders and news outlets of our financial picture including Measure A budgeting and actual spending, I hope we can communicate to all the facts to the community.

3. What criteria would you use to determine if a teacher was effective or ineffective, and based on that criteria, what should be done to ensure that the district only employs effective teachers.

This already is a subject of debate in the State and part of negotiations. We must agree on/find multiple fair measures to use on a consistent basis in order to determine effectiveness. These criteria must take into account the different styles and types of professional education strategies, not just have a single focus. Using agreed upon criteria, all staff will need to be trained, coached and evaluated in order to have the most effective teachers for our children. Using Master Teachers and administration, we should support the few ineffective teachers that we may have so that they may become more effective. I would encourage anyone to request a visit to our schools to see the wonderful teachers we have every day in Alameda!

4. What criteria would you use to determine if AUSD administration staff was effective or ineffective, and based on that criteria, what should be done to ensure that the district only employs effective administrators.

Very similar to teachers, administration evaluations need to involve fair and multiple measures that can be used on a consistent basis to determine effectiveness. These criteria must take into account the different styles and types of professional education strategies, as well as management skills need for the specific jobs. Using agreed upon criteria all staff will need to be trained, coached and evaluated to have the most effective administrators for our staff, children and community. Again, using managers and coaches we should support our staff to make sure we have only effective administrators.

5. If elected, what will you do to be proactive about securing adequate funding for our children? What outside-of-the-box ideas do you have to force the politicians to adequately fund our schools now?

I urge all to vote and actively support Propositions 30 and 38.

Unfortunately it seems that we must rely on the Courts to force Sacramento to change the way our schools are funded. That is what happened decades ago, and what AUSD and other districts are trying to do now with the Robles-Wong lawsuit. The reality is that it will be a long process, much too long, but hopefully in the coming years there will be some action by the Court or legislature to actual have some logic to the system and then adequate funding may follow.
Until the State economic picture dramatically improves, we need to continue to protect our schools with local funding. I have been advocating, working and volunteering for local funding for all of my time in Alameda, From the Alameda Education Foundation to PTA. Since 2000 I have given my best efforts to lead our parcel tax efforts to inform voters and the public about our needs, the funding from the State and the balance we must have to achieve the minimum education our students deserve. I meet with our State representatives, fellow local board members and advocates for education. I will continue those efforts, inside and outside of the system.

6. What single educational program and/or improvement will you push or recommend to better AUSD and describe the program and/or improvement.

Our public education system is complex especially across a K-12 district. Implementation of the Master Plan is what I am pushing for and is discussed in the next question.

7. In 2010, AUSD adopted a Master Plan, explain your understanding of the Master Plan and AUSD?s implementation of the stated goals.

I am proud that we established the Master Plan. It was a main goal of mine during the 2008 election, and I am proud that we held the many workshops around Alameda to discuss our public school system and what we wanted for our community. We have begun the implementation of the Master Plan in many ways, but still need to keep our focus on doing it well. The means reviewing and reporting progress as well as adjusting implementation, if needed.

The Master Plan called for neighborhood schools with innovative programs, holding high expectations of students and staff, ensuring we operate efficiently as possible and increasing local funding. These items were split into 8 areas where we have created Goals and Strategies for the coming years. We have already worked on increasing the efficiency of the Central Office. In addition, this year started the innovative programs at elementary schools (including the opening of the Maya Lin School), we have created the 10 Steps to Success goals, a reporting structure and of course passed Measure A thanks to so many community members stepping up to discuss the need and vote for our program.

8. As an elected official what is your specific role in promoting civic engagement as opposed to staff?s role?

My role is to make sure that we communicate as widely as possible the information regarding the school district to all stakeholders. To do this we must make sure policies are in place to give clear direction to staff, tools are available for efficient transmission and availability of information and to make sure staff is explaining the complexities of the numerous issues in as plain (non-technical) language as possible. We must have high expectations that our Superintendent, administrators and principals will help and lead the community engagement at their sites and throughout the District.

9. Who is funding your campaign and which groups and individuals have endorsed your candidacy?

I am funding my own campaign at this point, have not asked for groups to support me financially. My endorsements will be up on my website: www.ronmooney.net

I will be voting for Niel Tam for School Board as over the past four years I have come to admire his quiet thoughtful and deep questioning of what our vision and goals are, need to be and where we are heading. His knowledge of the District, coming from over 40 years as a teacher and administrator provides such valuable information and at times contrast. I highly value his point of view and collaboration.

I will be voting for Mike Robles-Wong for School Board. I have seen Mike?s leadership to look at issues, ask deep questions, look for other views and then build consensus. His many years of experience, both work and civic, makes me confident he would be a fine member of the board.

Mayor Launches ?Reboot? of Lincoln Park Planning Process

City to Designate Design Consultant to Work with Park Users and Neighbors on New Set of Proposals to Upgrade Park Facilities

Mayor Joseph A. Curtatone announced today that he has directed the Office of Strategic Planning and Community Development (OSPCD) to appoint a design consultant to manage a new and more comprehensive planning process for proposed upgrades to recreational facilities at Lincoln Park.

?We?ve had repeated requests from community members for expanded input on the selection of design alternatives for this valuable citywide recreational facility,? said Mayor Curtatone.? ?A lot of work has gone into analyzing the best ways to upgrade the park so that it can support a wide variety of uses, and three public meetings were held based on a set of preliminary design proposals. But it?s clear that some residents have not been aware of past opportunities to participate in public discussions, or would like more opportunity to comment on each step of the process.? I think it?s also clear that there are strong differences of opinion about how best to proceed in fulfilling Lincoln Park?s potential as a community resource.? Rebooting the process and adding additional outside expertise should address these concerns.?

?Somerville residents in every neighborhood of the city understand that we need to provide improved year-round access to athletic fields and recreational facilities wherever we can,? said Curtatone. ?More and more sports organizations are seeking more and more practice and playing time.? Restarting the Lincoln Park process, and creating an approach that involves all stakeholders at every step will actually save time in the long run and keep us moving toward a facilities upgrade plan that represents the fullest possible range of public input and review.?

The City had originally sought public comment on a plan to renovate Lincoln Park based on community requests for, among other improvements, a synthetic turf sports field, a grass field for passive recreation, renovation of the existing basketball courts and the creation of a seasonal ice rink. The plan also necessitated the construction of a new structure to house ice rink infrastructure as well as bathrooms, concessions and a skate rental area.

?The original design consultant did an outstanding job with the specific parameters we initially established, but we never asked for a truly comprehensive approach to reimagining Lincoln Park from the ground up.? That will be the new mission ? and since we plan to restart the process, we?re suspending public meetings until we can start fresh.? Curtatone said.? ?We expect the selection process to take several weeks.?

While its larger Live and Lounge units have primarily been purposed for households, its new Zipp speaker is the being touted as the "first and only" portable AirPlay speaker. Make no mistake, unlike B&O Play's portable AirPlay-equipped Beolit 12 ($800), the Zipp's loaded with Libratone's proprietary PlayDirect protocol, meaning it doesn't require a separate wireless network / router for iDevices to connect to it over the air. The Zipp moniker is a play on the swappable wool grill which cozies around its vertically-standing tubular enclosures. Weighing four pounds and measuring in at 10.2 inches high by 4.8 inches in diameter, this "portable" unit is a good bit larger than the Blutooth-equipped Jawbone Big Jambox placed sideways, but it'll certainly fit in a backpack -- hey, it does have a leather carrying strap. Thankfully, that weight is partially due to its internal rechargeable battery, which should last up to eight hours.

As far as the speakers go, you'll find a duo of 1-inch ribbon tweeters facing the sides for the left and right channels, along with a 4-inch up-firing woofer. The rig also features Libratone's signature FullRoom design, which forces a 360-degree dispersion of the sound by way of deflectors in front of the tweeters. Beyond that, it'll naturally work with Libratone's existing iPhone app, allowing you to change the DSP on the fly for optimal output regardless of its placement in a room. The Zipp will hit Apple Stores later this October wrapped with a single red or grey zippered grill for $399, while other retailers will carry the $449 Classic Color and Funky Color editions, which each come with a trio of those wool grills (black, blue and red for the Classic, and black, pink and yellow for the Funky). Past that, a single grill by itself will cost you a relatively expensive $49 directly from Libratone. Boosting natural marijuana-like brain chemicals treats fragile X syndrome symptoms

ScienceDaily (Sep. 25, 2012) ? American and European scientists have found that increasing natural marijuana-like chemicals in the brain can help correct behavioral issues related to fragile X syndrome, the most common known genetic cause of autism.

The work indicates potential treatments for anxiety and cognitive defects in people with this condition. Results appear online in Nature Communications.

Daniele Piomelli of UC Irvine and Olivier Manzoni of INSERM, the French national research agency, led the study, which identified compounds that inhibit enzymes blocking endocannabinoid transmitters called 2-AG in the striatum and cortex regions of the brain.

These transmitters allow for the efficient transport of electrical signals at synapses, structures through which information passes between neurons. In fragile X syndrome, regional synapse communication is severely limited, giving rise to certain cognitive and behavioral problems.

Fragile X syndrome is caused by a mutation of the FMR1 gene on the X chromosome. People born with it are mentally disabled; generally experience crawling, walking and language delays; tend to avoid eye contact; may be hyperactive or impulsive; and have such notable physical characteristics as an elongated face, flat feet and large ears.

The researchers stress that their findings, while promising, do not point to a cure for the condition.

"What we hope is to one day increase the ability of people with fragile X syndrome to socialize and engage in normal cognitive functions," said Piomelli, a UCI professor of anatomy & neurobiology and the Louise Turner Arnold Chair in the Neurosciences.

The study involved mice genetically altered with FMR1 mutations that exhibited symptoms of fragile X syndrome. Treated with novel compounds that correct 2-AG protein signaling in brain cells, these mice showed dramatic behavioral improvements in maze tests measuring anxiety and open-space acceptance.

While other work has focused on pharmacological treatments for behavioral issues associated with fragile X syndrome, Piomelli noted that this is the first to identify the role endocannabinoids play in the neurobiology of the condition.

Endocannabinoid compounds are created naturally in the body and share a similar chemical structure with THC, the primary psychoactive component of the marijuana plant, Cannabis. Endocannabinoids are distinctive because they link with protein molecule receptors -- called cannabinoid receptors -- on the surface of cells. For instance, when a person smokes marijuana, the cannabinoid THC activates these receptors. Because the body's natural cannabinoids control a variety of factors -- such as pain, mood and appetite -- they're attractive targets for drug discovery and development. Piomelli is one of the world's leading endocannabinoid researchers. His groundbreaking work is showing that this system can be exploited by new treatments to combat anxiety, pain, depression and obesity.

Historic Park Slope church needs money to sanctuary ceiling

Parishioners at an historic church in Park Slope where the ceiling partially caved in last fall are now hoping to raise as much as $1.5 million to make repairs.

Chunks of plaster fell from the sanctuary ceiling of the Old First Reformed Church of Brooklyn on Carroll St. last fall - and since then, worshipers have crammed into a smaller room next door.

?A million and a half is an enormous number. We have no idea how we?re going to raise it yet but we?re optimistic. We?ve already gotten so much community support,? said church pastor Daniel Meeter.

Since the ceiling collapsed, architectural engineers have been in and out of the church - built in 1891 - and estimated the cost of repairs to be anywhere between $700,000 to almost $1.5 Million.

Instead of the big, lavish standing-room-only holiday celebrations the landmark church has held, they?ve had stripped-down versions with classical guitars and a harpsichord replacing the grand pipe organ and lively celebrations.

The congregation - which has swelled to almost 400 people during holidays - is capped at just under 200 parishioners because of limited space in the area one-tenth the size of the church.

The first fundraising event - a bluegrass concert at the Bell House in Gowanus on Sunday - as already been a success. The venues 500 seats have completely sold out and more than $20,000 has been raised for church repairs.

?We need to do whatever it takes to save this space,? said Park Slope resident and concert organizer Michael Daves.

?It?s an architectural treasure and it?s really important to the community.?

Churchgoer and bluegrass performer Burkhard Bilger is one of seven different acts that are slated to take the stage.

Bilger - who performs with his wife and three kids - said he needed to do his part to get the hole fixed.

?I don?t think we can go on without using our main space,? said Bilger, 45. ?That combination of location, acoustics and physical beauty is something you just don?t find in this neighborhood.?

Daves and other churchgoers have more fundraising events in the works and are even mulling over which deep-pocketed benefactors they can ask for more donations.

Meanwhile Meeter said he?s not phased by the daunting figure. Almost $140,000 has already come in from local residents and Meeter said he?s holding out hope that the rest isn?t too far away.

?We?re people who live by faith,? said Meeter. ?Religious organizations believe in improbabilities and making the impossible possible.

Man allegedly steals $100K coin collection, then spends at face value on pizza and a movie

A 1930s Liberty quarter (Good Morning America)A young couple in Washington state may be guilty of committing an expensive crime for pennies on the dollar. Dakoda Garren, 19, has been charged with stealing a rare coin collection worth $100,000 and spending the coins at face value on a movie and pizza with his girlfriend.

The Columbian reports that a woman living in Woodland had her family coin collection stolen in May and says that Garren and his girlfriend Elizabeth Massman were the only people to visit her home during that period, when they were hired to do some part-time work.

Garren denied the accusation back in May, telling police they "didn't have any evidence against him," according to a report filed in Cowlitz County Superior Court.

But then Garren and Massman allegedly began using the coins at local establishments, spending them at face value, including a quarter that is estimated to be worth thousands of dollars.

The Daily News reports the collection includes a variety of rare coins, such as Liberty Head quarters, Morgan dollars and several others dating back to the early 1800s.

After conducting their investigation, police now say the couple spent several 1930s coins at a Battle Ground-area movie theater, using quarters worth between $5 and $68 each.

Later on the same day, they spent more of the coin collection at a local pizza restaurant, including a Liberty quarter with an estimated value between $1,100 and $18,500.

Garren has been charged with first-degree theft and is being held in jail on $40,000 bail. Which, technically, is an amount he could easily afford if the valuable coin collection were actually his.

For now, police have declined to detain Massman, saying she is nine months pregnant.

UK regulator finds BSkyB 'fit and proper'

(AP) ? British Sky Broadcasting is a "fit and proper" company to hold an operating license, U.K. regulators said Thursday in response to the phone hacking scandal that engulfed the parent company. But it criticized the former CEO and chairman, James Murdoch, for poor management.

The company's license was called into question because of the scandal at a newspaper owned by News Corp., which effectively controls BSkyB through a 39 percent shareholding.

If the company had not be found "fit and proper" it could have been stripped of the license that yielded a net profit of $1.4 billion in the year ending June 30.

The Office of Communications, known as Ofcom, concluded that James Murdoch was not complicit in a cover up at the tabloid News of the World, but his failure to initiate appropriate action on a number of occasions was "difficult to comprehend and ill-judged."

The report also found no evidence that Rupert Murdoch, James' father and CEO of News Corp., "acted in a way that was inappropriate in relation to phone hacking, concealment or corruption by employees" of his British newspapers.

Though Ofcom said it might review the situation if there are further revelations, the decision removed any immediate threat of BSkyB losing its license. The company's shares were up 0.9 percent at 733.5 pence in late morning trading in London.

"After a lengthy review process, we are pleased that Ofcom has now reached its conclusion and we look forward to continuing to develop our business for the benefit of customers and shareholders alike," BSkyB said in a statement.

News Corp. also welcomed the regulator's decision but contended that some statements about James Murdoch were "not substantiated by evidence."

James Murdoch became executive chairman of News Group Newspapers ? publisher of The Sun and the now-defunct News of the World ? and its parent company News International ? which also owns The Times newspapers ? in January 2008 and held the position until February this year. Both companies are ultimately owned by News Corp.

The phone hacking scandal, along with other allegations, has spawned investigations by a Parliamentary committee, a formal inquiry led by a judge, criminal charges against some journalists ? including Rebekah Brooks, former chief executive of News International ? and civil suits which forced the company to pay large settlements.

Public outrage following reports that the phone of a young murder victim had been hacked also led to News Corp. deciding two years ago to drop its bid to take full control of BSkyB.

Ofcom noted contradictory evidence by James Murdoch and two former senior employees about when Murdoch became aware that phone hacking at the News of the World went far beyond the company's long-standing claim that it involved a single rogue reporter and a private detective.

However, it said there was no evidence that he knew of "widespread wrongdoing or criminality" at News of the World.

The regulator limited itself to criticizing James Murdoch's actions as company director.

"We consider James Murdoch's conduct, including his failure to initiate action on his own account on a number of occasions, to be both difficult to comprehend and ill-judged."

Since February, James Murdoch has been a non-executive director of the company, and one of only four people on the 12-member board with connections to News Corp.

In May, the House of Commons' Culture, Media and Sport Committee concluded that Rupert Murdoch was "not a fit person to exercise the stewardship of a major international company." That conclusion, on a partisan split of 6-4, had no practical effect, however.

In its statement, News Corp. said it was pleased that Ofcom found that evidence related to misdeeds at the newspapers "does not provide any basis to conclude that News Corp. and Rupert Murdoch acted in a way that was inappropriate, and that there is similarly no evidence that James Murdoch deliberately engaged in any wrongdoing."

"We disagree, however, with certain of the report's statements about James Murdoch's prior actions as an executive and Director, which are not at all substantiated by evidence," News Corp. said.
